Description: Janet Bowles and Barry Bowles sued Jason Shackelford on an auto negligence theory and EW Scripps Company d/b/a KJRH Channel 2 on a respondeat superior theory claiming to have been injured in a car wreck caused by Shackelford.

There was no dispute that this case arose out of an accident that October 15, 2009 and involved a vehicle driven by Defendant Shackelford that struck the rear of a vehicle driven by Ms. Bowles. She claimed she sustained injury to her low back that eventually required surgical intervention consisting of a multi-level fusion in the lumbar spine.

Plaintiff claimed there there was no dispute on liability and pointed to the testimony of Mr. Shackelford where he accepted responsibility for the accident.

Defendants claimed that Plaintiff failed to acknowledge testimony by Ms. Bowles that could lead a jury to place some degree of contributory negligence on her.

Defendant also contested the damages claimed by Plaintiff.

Outcome: Settled and dismissed with prejudice.
