Description: COMES NOW, the Plaintiff, Marcia Ashley (hereinafter “Plaintiff’), and for her cause of action against Defendant Steve Paul (hereinafter “Defendant”) would allege and state as follows:

JURISDICTIONAL ALLEGATIONS

1. Naintiff is a resident of Cleveland County, Oklahoma.

2. Upon information and belief, Defendant is a resident of Oklahoma County, Oklahoma.

3. The acts and omissions complained of herein occurred in Cleveland County, Oklahoma making jurisdiction proper herein.

FACTUAL ALLEGATIONS

4. On or about Dccember 13, 2010, Defendant negligently operated his motor vehicle in such a manner that it collided with the motor vehicle being driven by Plaintiff.

5. The collision took place on Indian Hills Road, near 36 Avenue in Norman, Oklahoma.

6. As a result of the negligent actions of Defendant, Plaintiff has sustained serious and permanent injuries, has incurred medical expenses, endured pain and suffering and has been prevented from transacting her business.

7. WHEREFORE, Plaintiffs demands judgment against the Defendant in excess of the amount required for diversity jurisdiction pursuant to Section 1332 of Title 28 of the United States Code and for any and all further relief that she may be entitled to in law and equity.

Defendant's Answer to Plaintiff's allegations are not available.

Outcome: COME NOW the Plaintiff, Marcia Ashley, and dismisses her cause of action against the Defendant, Steve Paul, with prejudice to the re-filing of said cause. The Clerk of the Court is directed to file said Dismissal With Prejudice of record herewith.
