Description: Roy Moreland, as personal representative of the Estate of Dovie Moreland sued Chralette Decker, Terry Hamill and Treas Construction on auto negligence, wrongful death and respondeat superior theories claiming that Dovie Moreland was a passenger in a vehicle driven by Defendant Charlette Decker when she pulled out of a private driveway onto State Highway 3 east of Antlers, Oklahoma. Defendant Terry Hamil was driving west on State Highway 3 in a 2002 Doge Q25 Truck owned by his employer, Treas Construction. Plaintiff claimed that Hamill negligently failed to yield the right-of-way to Decker's vehicle causing a collision. Plaintiff also claimed that Decker failed to exercise due care in the operation of her vehicle.

Defendant Decker admitted that the accident occurred but denied fault. Hamill admitted that the accident occurred but blamed the accident on Decker.

Outcome: Settled for an undisclosed sum and dismissed with prejudice.
