Description: Ronnie Roberts sued Albert Lee Rauh on an auto negligence theory and H & L Tooth Company on a respondeat superior theory claimingt that Ruah caused a car wreck that injury him while Rauh was working to H & L.

On March 27, 2007, Plaintiff was driving his vehicle northbound on HWTY 169 in the right hand lane. Defendant Rauh was driving his vehicle northbound on HWY 169 and was behind Plaintiff. Plaintiff was in the process of exiting HWY 169 at 46th Street North when Defendant, Rauh, rear-ended Plaintiff, causing personal injuries to Plaintiffs neck and low back.

DAMAGES or RELIEF SOUGHT AMOUNT 1. Plaintiff sustained injuries to his neck and back (aggravation), 2. Incurred medical expenses of $49,436.67 3. Endured pain and suffering and lost wages in the amount of $6,218.11 (per Dr. Allen Fielding, off work from 06/01/07 until 09/19/07).

4. Defenses: GROUNDS FOR DEFENSES APPLICABLE STATUTE, ORDINANCE COMMON LAW RULE a. Lack of Causation to personal juries b. Pre-existing condition regarding neck c. Need for surgery not result of IVIVA d. Some treatment not necessary and charges not reasonable


Defendant, Rauh, was driving his vehicle in the course and scope of his employment with Defendant, H&L Tooth.

Outcome: Settled and dismissed with prejudice.
