Description: Plaintiffs, Erin Noble and Jonathan Honan, for their cause of action against the Defendant, allege and state as follows:

1. On or about April 3, 2010, Erin Noble was traveling eastbound on Robinson St. in Norman, Oklahoma. She was stopped in the left turn lane to turn northbound on NE 12th Ave.

2. Jonathan Honan was a passenger in the vehic’e driven by Ms. Noble.

3. Defendant, Charles Austin was also traveling eastbound in his vehicle on Robinson St. Mr. Austin failed to slow down or stop causing his vehicle to strike the right rear of Ms. Noble’s vehicle.

3. As a direct result of the collision, Ms. Noble and Mr. Honan suffered multiple injuries.

4. Ms. Noble and Mr. Honan have no fault in this collision. Defendant was negligent in one or more of the following particulars, including but not limited to:

a. Failure to devote full time and attention to his vehicle; and

b. Following too closely.

5. Defendant violated 47 OS. § 11-310 and is guilty of negligence per-se.

6. As a direct result of the negligence of the Defendant, Ms. Noble and Mr. Honan suffered damages in excess of the sum of Seventy-Five Thousand Dollars ($75,000). Plaintiffs claim damages for the physical pain and suffering, past and future; mental pain and suffering, past and future; permanent injury, lost wages, loss of earning capacity and for the reasonable and necessary medical expenses, past and future.

WHEREFORE, Plaintiffs Erin Noble and Jonathan Honan pray for judgment against the Defendant in an amount in excess of Seventy-Five Thousand Dollars ($75,000), and for costs, attorney fees, and such further relief to which they are entitled.

Defendant did not file an answer.

Outcome: COMES NOW the Plaintiffs, Erin Noble and Jonathan Honan, and hereby dismisses with prejudice their claim and cause of action against the Defendant, Charles Austin.
