Description: Joseph Duane Nelson sued Rebecca L. Williams on an intentional infliction of emotional distress theory.

Plaintiff filed a Petition in this case on October 30, 2009.

In the Petition, Plaintiff alleges that on “Septembe to falsely state that Plaintiff was a kidnapper and rapist knowing that not to be true;”

In the Petition, Plaintiff alleges that on “September 10,2009, Defendant caused to be falsely published written statements made by her that Plaintiff was a kidnapper and rapist;”.

In the Petition, Plaintiff alleges that “Since said dates and times herein mentioned, Defendant has continued to falsely state that Plaintiff is a kidnapper and a rapist;”.

In the Petition, Plaintiff alleges that as a result of the conduct of the Defendant as described in ¶4&5 of the Petition, “Plaintiff has been damaged in his reputation, has lost his employment and has suffered great pain of body and mind.”

In the Petition, Plaintiff alleges that the acts of the Defendant are intentional and made with total disregard for the truth and are done with the intent to inflict emotional distress on the Plaintiff.

In the Petition, Plaintiff alleges that as a result of the acts of the Defendant, Plaintiff has experienced “emotional distress all to the detriment of his mental and physical health.”

In his Petition, the Plaintiff asked for damages in excess of $10,000.00 and for punitive damages as well. Ex. A.

On November 2, 2009, the State of Oklahoma filed Criminal Felony charges against the Plaintiff, charging him with First Degree Rape and Kidnapping. Ex. B, Docket Sheet in Case No. CF-2009-2158, Tulsa County, Oklahoma.

On February 26, 2010, a preliminary hearing was held in Case No. CF-2009-2158. The Plaintiff Nelson was bound over to district court on all felony charges filed.

The case is set for jury trial on April 16, 2012, two weeks after the trial in this case is supposed to begin. Ex. B.

On September 9, 2009, the Defendant filed for a Protective Order (P0) against the Plaintiff in Case No. P0-2009-3214, styled Rebecca L. Williams v. Joseph Duane Nelson.

The PC was granted and has been ordered to be continued on several occasions, the most recent being on September 28, 2011.

Defendant moved for summary judgment.

Outcome: Motion for summary judgment granted. Joint Motion to Dismiss with prejudice filed June 12, 2012.
