Description: Thomas Gibson sued Paige Barnes on an auto negligence theory claiming to have been injured in a car wreck caused by Barnes.

The parties to this case were Thomas Gibson, the Plaintiff, and Paige Barnes, the Defendant.

In this case the parties agreed that:

Both parties agreed that a collision took place between automobiles driven by the parties on December 8, 2008 at Mingo & 114th St. in Tulsa County, Oklahoma.

Plaintiff claimed that he sustained injuries which were directly caused by the negligence of Paige Barnes in one or more of the following respects:

A. In failing to keep a careful lookout;

B. In failing to bring her vehicle to a stop within an assured clear distance ahead;

Paige Barnes, the Defendant, admitted that she was guilty of negligence in colliding with the rear-end of Plaintiffs vehicle, but denied that Plaintiff was injured or was injured to the extent the Plaintiff claimed.

BARCUS, MARK: PRETRIAL CONFERENCE HELD. MARK MILLER PRESENT FOR PLAINTIFF. STEPHAN WANGSGARD PRESENT FOR DEFENDANT. COURT ORDERS PARTIES TO ATTEND MEDIATION WITHIN 60 DAYS. COURT GRANTS AN ADDITIONAL 30 DAYS AFTER MEDIATION FOR VIDEO DEPOSITION. PRETRIAL ORDER TO BE SUBMITTED AFTER MEDIATION. JURY TRIAL SET FOR 8-13-12 AT 9:30 A.M.

Outcome: Settled and dismissed with prejudice.
