Description: Dr. Kenneth Blick and Helen V. Blick sued Steve Breed Construction Company, Hinnen Construction, LLC and Terry Hinnen d/b/a Hinnen Construction claiming that during the performance of repairs to the roof of Plaintiffs' home in 2007 a "Gatorade" type bottle fell or was place into the furnace vent which caused the furnace to contaminate Plaintiffs' home with carbon monoxide which poisoned Helen Blick causing neurological and other injuries.

Plaintiffs own a residential dwelling located at 3001 Broken Bow Road in Edmond, Oklahoma, Oklahoma County. Plaintiffs roof needed to be replaced and Defendant Steve Breed was hired by Plaintiffs to replace the roof. Plaintiffs contend that during the roof replacement, a Gatorade bottle was negligently placed in a furnace vent pipe by an individual working on the roof that caused it to become clogged. This went undiscovered by Plaintiffs until the furnace was used several months later. When the furnace came on, Plaintiffs contend that due to the Gatorade bottle plugging the pipe, carbon monoxide (CO) and other fumes were prevented from escaping through the roof vent as designed and instead spread throughout the interior of the house through the vent pipes. Plaintiffs allege this event resulted in carbon monoxide poisoning, primarily to Plaintiff, Veida Blick, causing severe and permanent injuries to Plaintiffs, including Loss of Consortium to Plaintiff, Kenneth Blick. Defendants deny all of the allegations of Plaintiffs.

In the Fall of 2007, Plaintiffs hired
Breed Construction Co. to replace
roof of their residence. Breed
retained the services of Terry ilinnen and Terry Hinnen Construction
replace the roof. At the time of the
replacement, one of the individuals working on the roof negligently placed
Gatorade bottle into the furnace
accessible from the roof. The bottle
as a cork and plugged the furnace causing noxious gases to leak into
house. Plaintiffs’ residence became
poisonous chamber, which trapped carbon monoxide and other poisonous fumes inside the residence which
inhaled by Plaintiffs.

Outcome: Settled and dismissed with prejudice.
