Department of Transportation sued Tulsa, Interests, LLC, RCB Bank, El Chico Restaurants, Inc. on eminent domain theories seeking to acquire by condemnation certain rights, title and interested in real property in which the Defendants held some interested to the improvement of Interstates Highway I-44 in Tulsa County, Oklahoma.
The Commissioners appointed by the court to conduct an independent appraisal of the fair market value of the land taken and any damage to the remainder awarded the Defendant's $875,000.00.
All parties filed demands for jury trial on the issues of damages.
Outcome: Settled for an undisclosed sum and dismissed during trial.
