Description: Monty W. Garmon sued Hannah Edith Worley and Michelle G. Gutierrez on auto negligence theories.
First accident occured between Garmon and Gutierrez. This accident
resulted in Ms. Worley's vehicle being pushed into Mr. Garmon's vehicle,
stopped at a light. Mr. Worley was not at fault. Although there was (in
reality) a dispute between who was responsible for the initial impact
(disputed light) - Ms. Gutierrez could not be located post-accident and was not
insured...and Ms. Worley (by the time this came for trial) was no longer
able to handle her own affairs and her son appeared on her behalf.
As such, defense strategy was to admit liability as to cause of accident with Mr.
Worley and defend on damages as being excessive and result of pre-existing
condition.
PL claimed approximately $21,000.00 in meds. Initial chiro was just under $4,000.00.
Outcome: Plaintiff's verdict for $4,000.00.
