Description: State of Oklahoma, ex rel. Department of Transportation sued Kevin Lee King, Cathey Darlene King, Bank of Oklahoma, N.A. and Rogers County on eminent domain theories seeking to acquire by condemnation certain rights, title and interests in properties owned by Defendants or upon which they had liens or claims for public purposes.
The Court appointed Jack Crosson, Kathy Geyer and Rick Thomas to serve as commissions to asses the value of the land or interests taken and the damages, if any, suffered by the remainder of the property after the taking. The commissioners filed a report stating that they believed that the damages suffered by the Defendants as a result of the taking would be $45,000.
The Highway Department paid the Commissioners award into the register of the Court and the money was paid to the Defendants. The Bank of Oklahoma disclaimed any interest in the award. Plaintiff and defendants asked for a jury trial on the issue of damages.
Outcome: Settled for $44,250.00.
