Description: Medical Malpractice - Brenda Marrs presented to the St. John Medical Center emergency room on September 17, 1998, complaining of weakness, nausea and chest pains. The parties further admit that Brenda Marrs underwent an angiogram and ratablational atherectomy on September 18, 1998, performed by defendant Dr. Haas. The parties admit that Ms. Marrs later fell into a coma and expired on September 22, 1998. The plaintiff claims that Dr. Haas negligently performed the rotablational atherectomy on Mrs. Marrs. The plaintiff also asserts that Dr. Haas breached his duty to obtain Mrs. Marrs' informed consent. Plaintiff seeks damages on behalf of Brenda Marrs as a result of defendants' alleged negligence and assault and battery. Plaintiff further claims that Dr. Haas is an agent of Heart Center of Tulsa and that Heart Center of Tulsa is liable for the acts of Dr. Haas. The defendants, Dr. Robert Haas and Heart Center of Tulsa, deny the claims of plaintiff David Marrs. The defendants deny that Dr. Haas was negligent in treating Brenda Marrs and deny that Dr. Haas breached the requisite standard of care in providing care and treatment to Mrs. Marrs. The defendants also assert that Mrs. Marrs fully understood any risks and alternatives and consented to the procedure.
