Description:

This accident occurred on June 10, 2000, at the intersection of 31st Street (a major E-W thoroughfare) and South 90th East Avenue (a residential street) in Tulsa, OK. The intersection is a three-way stop and S. 90th E. Ave. terminates at 31st Street. The intersection is normally controlled by a standard traffic signal, however, at the time of the collision, a storm had caused the lights to flash red in all directions.

The Defendant was SB on S. 90th E. Ave and the Plaintiff was WB on 31st Street. The Plaintiff was driving a Mazda p/u truck and claimed that he was in the right curb lane, stopped his car at the red light, watched a car turn left in front of him and then proceeded through the intersection on his turn. He claimed that the Defendant broadsided him as he passed in front of her while she was entering the intersection from S. 90th E. Ave. He estimated her speed at 35-45 mph.

The Defendant was driving a Pontiac Grand Prix and claims that she stopped behind a car, watched it turn left, watched other cars go EB and WB and then proceeded into her left turn. The Defendant claims she was about 50% through her left turn when she was struck by the Plaintiff's truck who was driving in the left passing lane.

Plaintiff claimed he sustained a neck injury and right shoulder injury and had a C6-7 cervical fusion two years after the collision. He claimed medical bills of approximately $42,000.00.
