Description: Tulsa, OK - The State of Oklahoma charged Dennis Ray Daney with first degree murder in violation of 21 O.S. Section 701.1 claiming:

DENNIS RAY DANEY, on or about 1/25/20 13, in Tulsa County, State of Oklahoma and within the jurisdiction of this Court, did commit the crime of MURDER IN THE FIRST DEGREE, a Felony, by unlawfully, feloniously, and willfully with malice aforethought, without authority of law, effect the death of Justin Jay Todd by stabbing him then and there and thereby inflicting certain mortal wounds in the body of said Justin Jay Todd from which mortal wounds the same Justin Jay Todd did languish and die on the 25th day of January, 2013.

The State further alleged:

That the said DENNIS RAY DANEY was heretofore on 10/24/2003, in Pittsburg County, Oklahoma, Case No. CF-2003-0459, convicted of a Felony, to-wit: the crime of POSSESSION OF CONTROLLED SUBSTANCE and sentenced to a term of 10 years. Said crime being an offense punishable under the laws of this state by imprisonment in the penitentiary. Said defendant being represented by counsel at the time, and said conviction being a final judgment in the case.
That the said DENNIS RAY DANEY was heretofore on 6/20/2006, in Pittsburg County, Oklahoma, Case No. CF-2006-023 1, convicted of a Felony, to-wit: the crime of DRIVING A MOTOR VEHICLE WHILE UNDER THE INFLUENCE OF ALCOHOL and sentenced to a term of 5 years. Said crime being an offense punishable under the laws of this state by imprisonment in the penitentiary. Said defendant being represented by counsel at the time, and said conviction being a fmal judgment in the case.
That the said DENNIS RAY DANEY was heretofore on 10/6/2008, in Pittsburg County, Oklahoma, Case No. CF-2008-0 103, convicted of a Felony, to-wit: the crime of ASSAULT ON A POLICE OFFICER and sentenced to a term of 10 years. Said crime being an offense punishable under the laws of this state by imprisonment in the penitentiary. Said defendant being represented by counsel at the time, and said conviction being a final judgment in the case.
Contrary to the form of the statutes in such cases made and provided, and against the peace and dignity of the state.
