Description: Medical malpractice - Plaintiff claimed that Dr. Chung Khan inadvertently cut the gastric artery during a hiatal hernia surgery with the result that Brad Kellerman, age 31, bled to death on the operating room table. Mr. Kellerman's family claimed that Dr. Khan was negligent in cutting the artery and that hospital personnel were negligent in failing to resuscitate him.
Dr. Khan admitted liability but contested damages. St. Clement denied liability for the death.
Outcome: Plaintiff's verdict for $4.9 million.
