Description: Muskogee, OK - Murderer Given Life Sentence

The United States of America charged David Brian Magnan, age 53, of shooting and killing James Howard, Karen Wolf and Lucile McGritt, all Native Americans and members of the Seminole Nation, at Howard's home.

The Government claimed that Magnan arrived at Howard's home in the early morning hours of March 2, 2004, where he shot the decedents were sleeping where he shot and killed the decedents and wounded another person. McGritt survived for a time and identified Magnan as the shooter.

Magnan was convicted of the murders by a State District Court and sentenced to death, but the conviction was overturned by the Tenth Circuit because the shooting occurred in Indian Country where the United States has exclusive jurisdiction.

Outcome: Defendant was sentenced to life in prison.
