Stan Lee of Vimont & Wills P.L.L.C., Lexington, Kentucky Description: Early Ray Bryant and Clara L. Bryant sued the City of Williamsburg and officer Brad Nighbert claiming that Nighbert violated Early Ray's civil rights, 42 U.S.C. 1983, by using excessive force when he was arrested in May of 2002. Bryant, age 63, who is a retired retired truck driver, claimed that a factory security guard made a slur about his wife over the citizen's band radio, and they got into an argument. Bryant called the police and after they arrived, Bryant claimed that Nighbert hit him from behind with a nightstick and threw him to the ground without provocation and injured him. He also claimed that he was falsely arrested and that he was refused medical treatment for his injuries. The defenses asserted by the defendants are not available.
