Description: The United States for the Use and Benefit of MMS Construction & Paving, L.L.C., sued Head, Inc.; Western Surety Company; and APAC-Central, Inc. on a breach of contract, false representation, deceit (fraud) and unjust enrichment theories.

Head, Inc. counterclaimed on a breach of contract theory.

Mr. Morlan,

As you know, the Court will ultimately rule on the equitable claims based on the jury’s advisory opinion. However, the jury also awarded MMS $350,000 on its unjust enrichment claim against Head. I attached the verdict form. We will argue that the 350,000 is not double recovery. The Defendant will argue that it is.

Outcome: Plaintiff's verdict for $651,575.65 against Head, Inc. and $350,000 against APAC. It also found in favor of Plaintiff on the deceit claim and awarded $150,000 in damages.
