Description: Edward Tuccion sued Rudy Marconi, Town Planner Betty Brosius and the Town of Ridgefield, Connecticut on a civil rights violation theory, 42 U.S.C. 1983, his First Amendment right to petition the government was violated. Plaintiff also claimed that the Town of Ridgefield engaged in a policy of refusing to meet with Mr. Tuccio due to the prior lawsuits, further violating his civil rights.
Outcome: A three-man, seven-woman jury found in favor of Tuccio’s civil rights by refusing and against Marconi but found in favor of Ms. Brosius. The jury awarded Mr. Tuccio compensation of just $1 and did not award punitive damages.
