Description: Lennar Corp. sued Briarwood Capital, LLC, Nicolas Marsch, III, Barry Minkow on defamation and conspiracy theories claiming that Marsch and Barry Minkow conspired to extort money from it.
Minkow's Fraud Discovery Institute alleged that Plaintiff operated like a Ponzi scheme in January 2009. Plaintiff claimed that Minkow made the allegations at the behest of Marsch, who company, Briarword Capital, LLC was involved in litigation with Lennar.
Minkow was indicted and pleaded guilty to making false and misleading statements about Lennar and was sentenced to five years in prison and ordered to pay $583 million in restitution.
Outcome: Plaintiff's verdict for $1 billion including $802 million in compensatory damages and $200 million in punitive damages.
