Description: Clyde L. Bennett, age 53, sued R&L Carriers, Inc. on malicious prosecution, false arrest, slander and other personal injury theories claiming that his former employer wrongfully and falsely accused him of stealing computer equipment out of the warehouse where he work. The charges filed against him were dismissed.

Defendant denied wrongdoing.

Outcome: Plaintiff's verdict for $3.2 million.

Comments: Editor's Note: News articles about this case reported that it took the jury only 30 minutes to reach its verdict. It will be interesting to see what the court does in response to the post trial motions that Defendant's attorneys will surely file and what the Circuit Court of Appeals will do with it assuming that it is not settled before it gets there. The Court has set the matter for a settlement conference in another effort to settle this matter.

From James Thorsen: The original claim that was filed in Chesterfield Circuit Court and removed by the Defendants to USCD court in Richmond and that went to the jury was for malicious prosecution only. The total verdict amount was $3.264,920.00. Compensatory was $1.716,920.00 jointly and severely, and punitives were $1.548,000.00 spread between the 4 defendants with the corporate defendant tagged at $1.5M and $48K between the three individuals.
