Defendant's Attorney: Heather A. Salg and Lara L. Miller

Description: Denver, CO: Insurance law lawyer represented Plaintiff, individually and as natural parents and next friends of K.C. and T.C., minors, who sued Defendant on a breach of insurance contract theory claiming damages in excess of $75,000 as a direct result of the failure of the Defendant to pay Plaintiff’s claims.

This case was initially filed in the La Plata County District Court, 2018CV30052, and was removed to federal court by the Defendant.

Outcome: On July 22, 2021, this Court issued an Order to Show Cause 143 , directing the parties to show cause why this action should not be dismissed for failure to prosecute. On August 2, 2021, the Plaintiffs responded 145 indicating that the case had been settled, but requesting that the Court delay closure of the case until after September 1, 2021 when the settlement could be effectively consummated. That deadline passed several weeks ago with no further communication from the parties. It appearing that the parties have fully resolved this matter and no longer request judicial intervention, the Court dismisses this action without prejudice pursuant to Fed. R. Civ. P. 41(b). The Clerk of the Court shall close this case. By Judge Marcia S. Krieger on 9/23/21. Text Only Entry (msklc2, ) (Entered: 09/23/2021)
