David Mueller sued Taylor Swift, Andrea Swift, Frank Bell and Scott Swift on tortious interference theories claiming that he was fired from his $150,000 a year job at KYGO radio in Denver after he was wrongfully was accused of groping Ms. Swift during a pre-concert photo session in 2013.

Mueller filed suit in the state district court in Denver. Ms. Swift removed the case to the Federal District Court in Denver based on complete diversity of citizenship between the plaintiff and all of the defendants.

Ms. Swift then counterclaimed on an assault and battery theory claiming that Mr. Mueller touched her in appropriately by "grabbing her ass" during the photo session.

Mr. Mueller admitted that he may have touched Ms. Swift during the photo session but denied that he groped her.

The State of the Case:

"Plaintiff David Mueller formerly worked as a morning show on-air personality at radio station KYGO in Denver, Colorado. He began work there in January 2013. Defendant Taylor Swift is a well-known signer, songwriter. Defendant Andrea Swift is Taylor Swift's mother and is part of Taylor Swift's Senior Management Team. Defendant Frank Bell is also part of Taylor Swift's Management Team and serves in the role of Director of Radio. On June 2, 2013, David Mueller attended a pre-concert meet and greet at Taylor Swift's concert at the Pepsi Center in Denver, Colorado. The Parties dispute the events of that meet and greet. Taylor Swift asserts that in the meet and greet, David Mueller inappropriately and without permission reached under her skirt and grabbed her bottom. David Mueller denies he inappropriately touched Taylor Swift. The incident was reported to KYGO by Frank Bell. Subsequently, David Mueller was terminated from his on-air postion. In response to his termination, David Mueller brought this lawsuit against Taylor Swift, Andreaq Swift and Frank Bell for intentional interference with contractual obligations and tortious interference with prospective business relations. Upon being sued, Taylor Swift filed a counterclaim for assault and battery against David Mueller."


Ms. Swift's motion for judgment as a matter of law at the end of Mr. Mueller's case in chief was sustained. His claimed against Andrea Swift and Frank Bell will be decided by the jury along with Ms. Swift's counterlclaim.

It is not clear why Judge Martinez sustained Ms. Swift's motion for judgment in her favor on Mr. Mueller's claim or claims is curious.

While Mr. Mueller suffered significant damages as a result of his being fired because of his alleged un-consented touching, it would seem that Ms. Swift suffered no harm from having been touched by Mr. Mueller other than some emotional harm.

I am reminded of a limerick that almost all law students learn that goes as follows:

"There once was a lawyer named Lex who said with composure when charged with exposure. De minimis non curat lex (the law does not fool with trifles)."

Mr. Mueller's lawyers probably represented him on a contingency fee basis, which costs him nothing.

The defendant's engaged a prestigious Washington, DC law firm at great expense. Ms. Swift got a judgment in her favor for $1 at a cost of maybe a million dollars. It is nice to be rich.
