Defendant filed a Motion to Suppress on April 10, 2017. Oral motion and evidence were heard by the Court on May 1, 2017. The Court took the matter under advisement to review State's Exhibit A and case law. Defendant's Motion to Suppress requests the Court issue a separate ruling and separate findings of fact and conclusion of law as to "each statement" and as to "each item of information." Pursuant to State v. Triplett, 355 S.W.3rd 543, the Court is not sure Defendant is even entitled to findings of fact in a Motion to Suppress. There is Civil Rule 73.01 which allows findings of fact upon issues specified by the party. The Court has no idea what Defendant wants findings on with the broad terms "each statement" and "each item of information." The Court, therefore, denies the request of Defendant to file a separate ruling and separate findings of fact. The Court does find that the confession and statements contained thereafter were initiated by Defendant. Said statements were not a result of coercion by law enforcement. Said statements were voluntary. Defendant's Motion to Suppress is overruled. State to pick up Exhibit A from the Court Clerk. So Ordered. Gayle L. Crane, Circuit Judge.
