Case Number: 02-cv-00388 Judge: Vicki Miles Court: United States District Court for the Western District of Oklahoma, Oklahoma County Plaintiff's Attorney: Michael W. Bowling and Madalene B. Witterholt of Crowe & Dunlevy, P.C., Oklahoma City, Oklahoma Defendant's Attorney: Susan A. Knight and Robert E. Manchester of Fenton, Fenton, Smith, Reneau & Moon, Oklahoma City, Oklahoma Description: The plaintiff's allegation of excessive force was predicated on the alleged inappropriate use of a police K-9; specifically, the question of fact was whether the dog was put on the plaintiff after he was in custody, or whether the dog was employed to get the plaintiff into custody. Obviously, the jury found the evidence to be in favor of the officers, who testified the dog was ultimately used because the plaintiff was non-compliant with lawful police commands, and the extremely icy conditions made it easier for the K-9 to secure the plaintiff. Outcome: Defendants' verdict. Plaintiff's Experts: Mr. Van Ness Bogardus Defendant's Experts: Mr. Joseph Callanan Comments: None |
