Description: Family and Estate of Lewis Timmons sued Ohio Power Company and American Electric Power Service Corporation on negligence theories for his wrongful death. Mr. Timmons was working for General Hydrogen and was delivering a load of hydrogen to the Mudkingum River Power Plant near Beverly, Ohio. Plaintiffs claimed that a hydrogen leak at the plant caused an explosion. Plaintiffs claimed that Ohio Power and AEP knew of the unsafe condition in the hydrogen storage area of the plant and failed to correct the problem.
Defendants admitted that they knew of the safety issues, plant officials were relying on General Hydrogen to maintain the hydrogen storage area at the facility.
Outcome: Plaintiffs' verdict for $1.998 million in compensatory damage and $5 million in punitive damages.
