The State of Minnesota charged Destiny Xiong with Criminal Vehicular Homicide and Criminal Vehicular Operation Resulting in Great Bodily Harm and carless driving.

Defendant dropped her phone and ran into some stopped cars killing Brea Miller and seriously injuring Michael Bain.

The accident occurred on May 1, 2016 on I-35W.

The State produced evidence that Xiong's vehicle was traveling between 51 and 64 mph.

Xiong had read a test message from her daughter and dropped the phone before running into the stopped cars.

Outcome: Guilty of misdemeanors careless driving and not guilty of all of other charges.
