Description: Marsha Simpson, individually and as parent and next friend of Marissa Simpson, a minor, sued David Roberts, M.D. and Jay B. Terry, M.D. on medical negligence (medical malpractice) theories against against Southwest Virginia Physicians for Women on a respondeat superior theory claiming that she received substandard care from the defendant physicians during the labor and delivery process in November 2001 that resulted in the birth of her daughter. She claimed that they should not have recommended induction of labor because she was a gestational diabetic. She claimed that she should have had a Caesarean section.
She claimed that as a direct result of the care that she received, her daughter was born with dangerously low blood pressure, and with a loss of one-third to one-half of her normal blood supply. She also claimed that her kidneys were destroyed and suffered brain damage from lack of oxygen.
Marissa underwent to kidney transplants and has cerebral palsy.
Outcome: Plaintiffs' verdict for $9 million.
