Description: Drury Southwest, Inc. sued Louie Ledeaux #1 Inc. on a breach of contract theory claiming that Louie Ledeaux breached its lease agreement with Louie Ledeaux over the operation of a stand alone restaurant located in front of a Drury hotel in north San Antonio.
Louie Ledeaux counterclaimed on breach of contract, fraud, negligent misrepresentation, violations of the Texas Property Code and violations of the Texas Deceptive Trade Practices Act. Louie Ledeaux claimed that Drury Southwest fraudulently induced it into signing the lease by failing to disclose material information and making material misrepresentations regarding the leased premises and its intent to build a $100,000 outdoor patio at the leased premises. Louie Ledeaux further claimed that Drury Southwest locked Louie Ledeaux out of the leased premises without any notice in violation of the lease and the Texas Property Code.
Outcome: Plaintiff's verdict for $112,533 and for Defendant on its counterclaim for $2.7 million.
