Description: The Family and Estate of Sherrie Ann Burkhardt sued York Hospital, Dr. Daniel Motter, Dr. John Bobin and Cardiac Diagnostic Associates on medical negligence (medical malpractice) claiming that Ms. Burkhardt, age 53, died as a direct result of substandard care provided to her post surgically from internal bleeding on December 17, 2007. Ms. Burkardt was admitted to the hospital with an admitting diagnosis of heart attack. A cathereterization was performed and three stents were placed. Subsequent to the surgical procedure her blood pressure fell and her heart rate increased.

Plaintiffs claimed that the attending doctors failed to order tests that would have identified the cause of the falling blood pressure. While eventually diagnosed and repaired but she subsequently died who the harm caused by the bleeding.

The defenses asserted by Defendants are not available but it appears that Dr. Motter and Dr. Bobin disagreed about what information was communicated by Motter to Bobin about Ms. Burkhardt's condition during the period when her blood pressure was falling.

Outcome: Plaintiff's verdict for $6 million with a finding that York Hospital was 75 percent at fault, while Cardiac Diagnostic Associates is 25 percent to blame.
