The State of Oklahoma charged Candace Marie Stanley a/k/a Candace McGillivray, age 23, with one count of child neglect in violation of 21 O.S. 843.5(C) for abusing several drugs before giving birth by exposing her unborn child to Xanaz, marijuana, methamphetamines and/or heroin. The State also alleged that Stanley failed to provide appropriate care to her newborn child by failing to follow a 911 dispatcher's instructions to provide basic first aid and help her baby breathe and stay warm. When emergency responders arrived at the Defendant's apartment, where she had given birth to the child, they found the infant in a pile of trash and Defendant swinging the plaenta around and saying that the child was an "alien."
Title 21 O.S. 843.5 (C) provides:
"C. Any parent or other person who shall willfully or maliciously engage in child neglect shall, upon conviction, be punished by imprisonment in the custody of the Department of Corrections not exceeding life imprisonment, or by imprisonment in a county jail not exceeding one (1) year, or by a fine of not less than Five Hundred Dollars ($500.00) nor more than Five Thousand Dollars ($5,000.00), or both such fine and imprisonment. As used in this subsection, "child neglect" means the willful or malicious neglect, as defined by paragraph 47 of Section 1-1-105 of Title 10A of the Oklahoma Statutes, of a child under eighteen (18) years of age by another."
Outcome: Defendant pled guilty and was sentenced to 15 years in prison.
