Montefiore Medical Center Case Number: Judge: Court: Supreme Court, Bronx County, New York Plaintiff's Attorney: David Perecman, The Perecman Firm, P.L.L.C., New York, New York Defendant's Attorney: Description: Plaintiff sued Montefiore Medical Center on a medical negligence (medical malpractice) theory claiming that emergency room doctors at the hospital acted below the standard of care when they failed to properly diagnose and treat him when he presented with with a fever. He claimed that because no blood test was performed to determine if he had a bacterial infection, he was diagnosed as having a viral flu infection rather than a bacterial staph infection, which almost killed him. As a result of the failure to diagnose and treat the infection, Plaintiff developed pericarditis with necessitated heart value replacement surgery to save his life.
