Description: Linda Dunn Beck and Donna Beck, individually and on behalf of the Estate of Donald Lynn Beck sued Dr. Earl P. Webster, Dr. Donald Desantis, LexMedical, Inc., Lexington Memorial Hospital and Hospital Medicine Physicians of Davidson County on medical negligence (medical malpractice) wrongful death theories claiming that Beck, age 59, died as a direct result of substandard care. They claimed that Beck entered Lexington Memorial Hospital on June 25, 2007 with complaints of epigastric pain that radiated around to the mid-back. A CT scan revealed the presence of gallstones. He was admitted for removal of his gallbladder surgically. Post operatively, he developed an infection but allegedly did not receive appropriate antibiotics.

Defendants generally denied all of the allegations made by Plaintiff and specifically denied that Beck had an infection. In addition, they claimed that he died from severe atherosclerosis disease.

Outcome: Defendant's verdict in favor of Webster.
