Description: Jack Nemcheck sued the City of Garden City and officer David Wheet on a civil rights violation theory claiming that a Garden City police officer used excessive force when he used a police dog to subdue him during a traffic stop.
Nemcheck was stopped by three Garden City police officers for a traffic violation in February 2004.

Officer Wheet testified that Nemechek became combative and that he eventually released the police dog to help subdue him.

Defendants denied wrongdoing.
