Description: Jacksonville, FL - Jury Convicts Defendant In 14 Minute on Murder and Rape Charges

The State of Florida charged Donald Smith, age 61, with kidnap, sexual battery and first-degree murder in the kiddnapping, raping and murdering of Cherish Perrywinkle, age 8.

The State charged that Smith introduced himself as a good Samaritan to the mother of the child at a Wal-Mart Store and offered to help her family. Smith offered to buy some cheeseburgers for the woman and her children at the McDonald's in the store but it was closed. He then offered to take the child to get some food and left with Cherish in his vehicle. She was never seen alive again.
