Description: Los Angeles, CA - Ryan and Jessica Larkin sued the Regents of the University of California on medical malpractice theories claiming that their Mother, Deborah Larking, age 44, died on December 27, 2013 will a patient at the Ronald Reagan UCLA Medical Center as a direct result of substandard care during a surgical repair of a hiatal hernia during which her stomach was perforated.

Outcome: Plaintiff's verdict for $1.75 million possibly limited to $250,000 because of California's cap on pain and suffering damages.

Comments: Editor's Comment: The $250,000 limit on awards for pain and suffering in California is arbitrary and capricious and the fact that it has not been increased for inflation for a very long time effectively reduces the value of a $250,000 award every year.
