Description: Ofelia Reynaga, the mother of Jessica Ramirez, age 22, sued AHMC Healthcare, Inc. d/b/a Greater El Monte Community Hospital and others on medical negligence theories (medical malpractice) claiming that the hospital's personnel acted below the standard of care when they failed to expeditiously transfer Jessica to another medical facility where an air-rifle pellet could be removed from her brain in 2007. Plaintiff claimed that the delay cause severe brain damage that left Jessica in a persistent vegetative state. Ms. Ramirez was accidentally shot in the head at her home and walked into the emergency room seeking care but waited five hours for care as her condition deteriorated. Pressure caused by intracranial bleeding caused permanent brain damage before appropriate surgical intervention occurred.

Defendant claimed that appropriate care was provided to Ramirez.

Outcome: Plaintiff's verdict for $12 million.

Comments: Editor's Note: The cost of caring for someone like Jessica appropriately can run into the hundreds of thousand annually. As a result, jury verdicts in vegetative state patients are when negligence and causation are proven run into the millions.
