Case Style: Family and Estate of Jennifer Lea Strange v. Entercom Communication Corp. and Entercom Sacramento, L.L.C.

Case Number:

Judge: Lloyd A. Phillips

Court: Superior Court, Sacramento County, California

Plaintiff's Attorney: Roger A. Dreyer, Dreyer Babich Buccola Callaham & Wood, LLP, Sacramento, California for Billy, Ryland and Jonie Strange and Harvey R. Levine, Levine Steinberg Miller & Huver, San Diego, California for Keegan Sims

Defendant's Attorney: Don Carlson, Carlson Calladine & Peterson, L.L.P., Sacramento, California

Description: Family and Estate of Jennifer Lea Strange, age 28, sued Entercom Communication Corp. and Entercom Sacramento, L.L.C. on negligence theories for her wrongful death. Mrs. Strange died as a direct result of her participation in a water drinking contest conducted by KDND on January 12, 2007 to see who could drink the most water without urinating. The contest which was run on the "Morning Rave" show was called the "Hold Your Wee for a Wii" and promosed a Nintendo video game to the winner. Plaintiffs claimed that the contest violated Defendants' internal policies and procedures and had not been approved by corporate management or legal staff. They also claimed that Defendant's employees knew that drinking large quantities of water could be dangerous.

The Station received multiple calls from listeners advising of the dangers of what they were putting the contestants through but never communicated that information to the contestants.

Defendants denied wrongdoing and claimed that Jennifer Strange was contributorily negligent in her own death.

Outcome: Plaintiffs' verdict for $16.6 million with no finding that Ms. Strange was at fault.
