Description: Kevin O'Bryan sued Primal Vantage Co. on negligence and products liability theories that he was seriously injured in a fall from a tree stand. O'Bryan and his wife claimed that Pimal failed to reasonable warn about the risks of the product. Plaintiffs' product liability claim was based on a claim that the product was unreasonably dangerous and that the manufacturer failed to warn about the dangers.

The defenses asserted by the Defendant are not available other than it apparently claimed comparative fault.

Outcome: Plaintiff's verdict for $8.5 million finding that the parties were equally at fault. The verdict included $869,975 for past medical expenses, $1.2 million for lost wages and $13 million for pain and suffering, as well as $80,000 to Sante O'Bryan, now his ex-wife, for loss of consortium.
