Additional Information: Mr. Stuller is a native of Milwaukee, Wisconsin. He graduated with honors from the University of Wisconsin - LaCrosse in 1975 where he was captain of the University's first NAIA national championship team and won two individual national championships in gymnastics. Following graduation, he coached at the nationally recognized National Academy of Artistic Gymnastics in Eugene, Oregon and was named United States Gymnastics Federation Coach of the Year for Oregon in 1982. While coaching, Mr. Stuller did graduate work in journalism at the University of Oregon and then began a career as a freelance writer, publishing articles on sports and outdoor-related topics in several national magazines including Outside, Sports Illustrated and Atlantic Monthly. Mr. Stuller received his J.D. from the University of Colorado in 1992. He published an examination of the United States Supreme Court's decision in the University of Colorado Law Review as a second-year student and served as articles editor of the Review the following year, organizing symposia on legal scholarship as well as the intersection of race, class and environmental regulation. Following graduation, Mr. Stuller worked for former Colorado Supreme Court Justice Jean E. Dubofsky specializing in appellate practice. He assisted with the successful constitutional challenge to Amendment 2. He then served as a law clerk to the Honorable Judge Jim R. Carrigan of the U.S. District Court for the District of Colorado. Mr. Stuller joined Caplan and Earnest in 1994. His practice emphasizes education law, constitutional law, litigation and appellate practice. He regularly appears before the appellate courts of Colorado. Published decisions in which Mr. Stuller was substantially involved include: Fleming v. Jefferson County School District, 298 F.3d 918 (2002) (the Columbine High School "tiles" case); Castaldo v. Stone, 192 F. Supp. 2d 1198 (D. Colo. 2001) (the Columbine High School liability case); Board of Education v. Wilder, 960 P.2d 695 (Colo. 1998) (case concerning the First Amendment rights of teachers); Lopez v. Trinidad School District, 963 P.2d 1095 (Colo. 1998) (student drug testing); West Yuma School District v. Flaming, 938 P.2d 151 (Colo. 1997) (teacher dismissal litigation); and Board of County Commissioners v. Bainbridge, 929 P.2d 691 (Colo. 1996) (school impact fees). Mr. Stuller has published articles on First Amendment issues in both scholarly and professional journals. His articles include: "High School Academic Freedom: The Evolution of a Fish Out of Water," 77 Neb. L. Rev. 301 (1998); "Hate Speech and the Public Schools," 2000 School Law in Review; "The Conundrum of Academic Freedom," Inquiry and Analysis, June 1998. In addition, Mr. Stuller has presented lectures on education law and constitutional issues at state and national attorney conventions and has taught education law as a member of the adjunct faculty at the University of Colorado School of Law. He is the former chairman of the Colorado Council of School Attorneys where he has served as the council's liaison to the Colorado Association of School Board's legislative resolutions committee. Mr. Stuller is admitted to practice law in the State of Colorado, the U.S. District Court for the District of Colorado, the 10th Circuit Court of Appeals and the United States Supreme Court. Mr. Stuller continues to pursue his long time interest in sports and outdoor activities including rock climbing, rafting, kayaking and working with youth sports teams. He served as Chair of the City of Boulder's Parks and Recreation Advisory Board.
