Ms. Foley is one of only 122 Ohio State Bar Association Board Certified Labor and Employment Specialists. She has been a litigation attorney for over thirty years and has represented a wide range of management side clients from not-for-profits and small entrepreneurs to Fortune 500 companies. Ms. Foley has tried cases to a verdict in jury and non-jury trials, and briefed and argued appeals in state and federal courts including the Sixth, Eighth, and Third Circuit Court of Appeals and the Ohio Supreme Court. She has represented management clients in suits involving sexual harassment, gender, race, age, ethnic, disability and religious discrimination under Title VII of the Civil Rights Act, the Age Discrimination in Employment Act, Americans with Disabilities Act, O.R.C. Section 4112 et seq., the Family and Medical Leave Act, whistle-blower cases, non-compete agreements, retaliation, breach of employment contracts, and all aspects of wrongful discharge. Ms. Foley has represented management clients in administrative proceedings before the National Labor Relations Board, Equal Opportunity Employment Commission, Ohio Civil Rights Commission, Occupational Safety and Health Administration, Ohio Unemployment Compensation Review Commission and the Ohio Industrial Commission. In addition to her litigation practice, Ms. Foley has defended companies in U.S. Department of Labor wage and hour investigations and has designed and implemented in-house voluntary corporate wage and hour self-audits for some of the area’s most prominent publicly held companies. Ms. Foley’s employment practice includes a significant amount of employment related counseling in all aspects of labor and management relations, statutory compliance, hiring and termination decisions including WARN Act compliance and Reduction-in-Force (RIF) analysis and implementation. She has prepared and implemented numerous employee policy and procedure manuals and frequently conducts in-house non-discrimination and sexual harassment training of both management and hourly workers. Ms. Foley is a frequent lecturer for the Cleveland Metropolitan Bar Association and the National Business Institute on employment law and best practices issues. Ms. Foley is a member of the Federal Bar Association, the Ohio State Bar Association, the Cleveland Metropolitan Bar Association, the New Jersey State Bar Association, and the American Bar Association.
